Troy Kelley's Attorney Wants Criminal Case Split Up, Some Charges Dismissed

Indicted Washington State Auditor Troy Kelley has pleaded not guilty to all charges related to his past business practices.

The attorney for indicted Washington State Auditor Troy Kelley wants some of the charges against his client dropped. Attorney Angelo Calfo is also petitioning a judge to break apart the criminal indictment into separate trials.

Calfo is approaching the Troy Kelley case like a drawn-out boxing match. In his latest court filings, Calfo suggested the 48-page indictment against Kelley is a case of prosecutors throwing “as much mud on the wall to see if it can stick.” Calfo has asked a judge to split up the 17-count indictment into “manageable, smaller pieces” to comply with rules of criminal procedure.

Separately, Calfo is arguing to have one tax-related charge dropped on the argument the six-year statute of limitations has passed. He wants another charge dismissed because he argues it’s duplicative. In his filings, Calfo also raises the specter that Kelley may want to testify in his own defense on charges he took illegal business deductions.

Prosecutors have not yet filed their responses to these motions and the U.S. Attorney’s Office typically does not comment on pending cases.

Kelley has pleaded not guilty to all charges related to his past business practices and is on leave from office pending the outcome of his trial.
